Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AgentPulse website and the AgentPulse agent software (together, the “Service”), operated by Dustinn Stroud from Ontario, Canada. By subscribing to or using the Service, you agree to these Terms.

This is a starting template provided in good faith, not legal advice. Please review it (or have a lawyer review it) before relying on it for your business.

1. The Service

AgentPulse is a beta Linux/macOS monitoring and remediation agent intended for hosts you own or control. It monitors system conditions and, only where you explicitly enable it, performs remediation actions such as removing files in paths you configure or restarting services you allowlist.

The Service is offered as a paid beta. It is provided “as is” and is under active development. Features described as roadmap are not guaranteed. We may change, add, or remove functionality during the beta.

You agree not to use the Service to harm systems you do not control, to violate laws, or to circumvent the safety controls built into the agent.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Automated remediation carries inherent risk; the agent’s safeguards (dry-run, validation, verification, escalation, alert-only defaults) reduce but do not eliminate that risk. You are responsible for testing the Service on non-critical systems before trusting it with production workloads.

7. Limitation of liability

To the maximum extent permitted by law, AgentPulse and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid for the Service in the three months preceding the claim.

8. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access for violation of these Terms or to comply with law.

9. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules.

We may update these Terms. Material changes will be reflected by the “Last updated” date above. Continued use after changes means you accept them.
